Noteworthy Cases

  • Allen v. Security National Insurance Co./Monnex Insurance Mgmt. Inc. – This appeal decision from Director’s Delegate Blackman clarifies, in a helpful way for claimants, how to rate overlapping impairments when attempting to determine an individual’s whole person impairment under the AMA Guides, in the context of a catastrophic impairment application.
  • Campbell v. County of Bruce – successful trial verdict for quadriplegic client apportioning 100% of the blame to the Defendant, County of Bruce
  • Shawnoo v. Certas – this case, for a client with a catastrophic brain injury, resulted in the court recognizing the provision of attendant care services by electronic/indirect means as valid care for the purposes of claiming the attendant care benefit payable under the Statutory Accident Benefits Schedule – September 2010
  • Folmer v. Graham – championed the rights of an above-knee amputee in the Ontario Court of Appeal.
  • Hubbard v. Pembridge Insurance – successful precedent-setting FSCO arbitration decision concerning the test governing benefits payable to an injured accident victim under the OMPP Insurance Act regime, on behalf of a claimant who was under the age of 16 at the time of his accident.
  • Andrew has successfully recovered millions of dollars in negotiated settlements over the last decade, without having to proceed to trial, on behalf of accident victims suffering from brain injuries, amputations, spinal cord injuries, serious orthopaedic injuries, and chronic pain.
